1. Agreement to These Terms

These Terms of Service govern the relationship between you and Afterglow by Lindsay LLC when you use this website, contact the studio, book a service or purchase a poured piece. Please read them before you place a request. By using the website or by booking a service, you agree to these terms. If you do not agree, please do not use the website or the studio services.

These terms apply alongside any written confirmation that the studio sends for a specific order. Where a written confirmation differs from these terms, the confirmation takes priority for that order only. Any other document, including a client purchase order, applies only if the studio accepts it in writing.

2. About the Studio

Afterglow by Lindsay LLC is a hand poured candle studio operating from the address below. The studio is a working bench rather than a retail shop, and visits are arranged by appointment.

3. Eligibility

You must be at least eighteen years old to book a service or place an order on your own behalf. A person under that age may take part in a studio pour night when a parent or guardian books the place and accepts these terms on behalf of the younger guest.

By using the website, you confirm that the information you give us is accurate and that you are able to enter into a binding agreement. If you are acting for a business or another person, you confirm that you have authority to accept these terms on that business or person behalf.

4. Studio Services

The studio offers small batch pours, scent blending sessions, wax care clinics, custom label painting, studio pour nights and gift set assemblies. Each service has its own practical limits, which we explain before a booking is confirmed.

Descriptions on the website are written in good faith and are intended to give a fair picture of what the studio does. Because poured pieces are made by hand, small variations in colour, surface finish and scent intensity are normal and are part of the character of the work rather than a defect.

The studio may decline a request that it cannot complete safely or to a reasonable standard, or that conflicts with these terms. If a request is declined, we will explain the reason and, where possible, suggest an alternative service or date.

5. Orders and Reservations

An order or reservation begins when you send a request and the studio replies with a written confirmation that sets out the service, the number of pieces, the agreed shelf or appointment date and the price. A request alone does not create a booking.

The studio may hold a provisional date for a short period while details are agreed. If the details are not confirmed within that period, the provisional date may be released so that another client can use the bench.

Where a booking depends on a detail supplied by you, such as a vessel, a scent idea or label wording, the studio may need that detail before the pour can be scheduled. A late detail can move the shelf date, and the studio will tell you if that happens.

6. Pricing and Payment

Prices are confirmed in the written confirmation for each order. A price may change if the scope of an order changes, for example if the number of pieces or the complexity of custom label painting increases after the confirmation. The studio will not change a confirmed price without telling you first.

The studio may ask for a deposit to hold a shelf date, particularly for a custom batch or a gift set reserved during the winter window. The deposit is applied to the final price when the order is complete. Payment methods are agreed in the confirmation.

Invoices are due on the terms stated in the confirmation. If an invoice remains unpaid after the stated period, the studio may pause work and may release the reserved shelf date. The studio will make reasonable efforts to contact you before taking either step.

7. Lead Times and Cure Periods

Poured pieces need time. A typical small batch pour takes about six weeks from the day the wax melts to the day a piece is ready to leave the shelf, because the cure is part of the making and cannot be shortened without affecting the finish or the burn. Scent blending sessions and wax care clinics are shorter, and custom label painting usually adds one to three weeks depending on the set.

Lead times given on the website or in conversation are estimates made in good faith. If a lead time changes, the studio will tell you as soon as it knows and will offer the nearest alternative date. The studio does not accept a penalty for a delayed shelf date unless it has agreed to one in writing.

A piece will not be released before its cure is complete. This rule protects the quality of the work and the safety of the burn, and it applies to every order regardless of the date requested.

8. Cancellation and Rescheduling

You may cancel or reschedule an appointment by writing to the studio. Please give as much notice as you can, because a held date keeps the bench out of use for other clients. The studio will confirm the change in writing.

Where a deposit has been paid, the studio will apply it to a rescheduled date when the change is made with reasonable notice. If an order is cancelled after materials have been purchased or work has begun, the studio may keep the part of the deposit that covers the cost already incurred and will account for the remainder.

The studio may cancel or reschedule an appointment when it is necessary for safety, for the maintenance of the bench or for an unexpected event. In that case the studio will offer a new date and will refund any deposit that cannot be applied.

9. Collection and Delivery

Finished pieces are normally collected at the studio during business hours, by arrangement. If you cannot collect, the studio may hold a piece for a reasonable period. Where a piece is held for an extended period, the studio will discuss storage and any additional arrangement with you.

Delivery can be arranged within the United States for a fully cured gift set or a batch that is packed for travel. Risk in a delivered piece passes to you when it is delivered to the address you provided. Please tell the studio promptly if a parcel arrives damaged so that the studio can help resolve the matter with the carrier.

If you provide an incorrect address, the studio will make reasonable efforts to redirect a parcel, but any extra cost or loss caused by the incorrect address is your responsibility.

10. Returns and Remedies

Because poured pieces are made to order in short batches, the studio does not accept a return simply because you have changed your mind after collection. If a piece does not match the written confirmation, please tell the studio within a reasonable period and we will work with you to put it right.

Where a piece has a genuine fault in the pour or the wick, the studio may offer a replacement, a repair or a refund of the price paid for that piece. The studio may ask to see the piece or a photograph so that it can understand the problem and improve the next batch.

Damage caused after collection by improper use, storage or handling is not covered. The care sheet that leaves with every piece sets out the use and storage steps that keep it in good condition, and the wax care clinic is available if you would like more guidance.

11. Safe Use of Poured Pieces

A burning candle must never be left without attention. Keep a piece away from curtains, paper and any other flammable material, and place it on a heat resistant surface that is clear of clutter. Keep the wick trimmed to a short length before every light, and stop burning once the wax reaches the base of the vessel.

Keep pieces out of the reach of children and pets. Do not move a lit piece, and do not add anything to the wax. If the flame becomes too tall or begins to smoke, extinguish the piece, allow it to cool and trim the wick before relighting.

The studio provides these steps as guidance rather than as a guarantee of safety. A lit candle always carries some risk, and the person who lights it is responsible for using it with care and in line with the instructions on the piece and the care sheet.

12. Custom Work and Client Materials

For custom label painting and personalised gift sets, the studio works from the direction you provide. Please make sure that any text, artwork or material you supply is yours to use and does not infringe the rights of another person. The studio may decline a direction that it believes is unlawful or that conflicts with its standards.

A client supplied vessel must be assessed at the bench before it is used. The studio may decline a vessel that will not take the wax or the wick safely. Where a vessel is accepted, the studio will treat it with care, but it cannot accept responsibility for a vessel that fails after the pour because of a weakness in the vessel itself.

Colour and wording are agreed from a sample before the full set is started. Small variations between hand painted panels are part of the finish. If a batch departs from the agreed sample in a material way, the studio will put it right before the piece is released.

13. Studio Conduct

The studio is a working space with hot wax, open vessels and sharp tools. Guests are asked to follow the guidance of the person running the session, to keep the bench clear and to stay away from the kettle unless invited. This keeps everyone safe.

Please arrive at the agreed time and let the studio know if you will be late. A session may need to be shortened or rescheduled if a group arrives well behind schedule, because the wax is prepared for a set time and does not wait.

The studio may ask a person to leave a session if their conduct puts others at risk or disrupts the work. In that case the studio will not be required to refund the price of the session.

14. Intellectual Property

The content of this website, including the text, the design elements and the studio name, belongs to Afterglow by Lindsay LLC or is used with permission. You may read and share the content for personal and non commercial purposes, but you may not copy it for a competing business or represent it as your own.

Studio imagery, batch sheets and scent blend records remain the property of the studio. Where a scent blend is created for you in a blending session, the studio keeps the recipe on file and may reproduce that blend for you in a future order. The studio will not use your personal signature blend for another client without your agreement.

Any material you send to the studio for custom work remains yours. By sending it, you give the studio permission to use it for the purpose of completing your order and for no other purpose.

15. Acceptable Use of the Website

You may use the website to learn about the studio, to send a message and to arrange a service. You may not attempt to break the security of the website, to interfere with its normal operation, to scrape its content at scale or to use it to send unlawful or harmful material.

The studio may suspend or block access to the website where it believes that a person is using it in a way that is abusive, fraudulent or harmful. This step is taken to protect the studio, its clients and the people who host and maintain the site.

The website is provided for information and for arranging services. It is not a substitute for the written confirmation that the studio sends for an order, and a detail on a web page does not override the terms of that confirmation.

16. Third Party Services

The studio relies on a small number of outside services for hosting, email, scheduling and accounting. These services may sit behind some of the features of the website, such as the contact form or a booking link.

The studio is not responsible for the content, availability or practices of a third party service, and a link to such a service is not an endorsement. Where a third party service has its own terms, those terms apply to your use of that service.

If a third party service fails or becomes unavailable, the studio will make reasonable efforts to keep the studio running by another route, such as direct email or telephone. The studio does not guarantee that the website will always be available.

17. Disclaimers

The website and its content are provided as they are. While the studio takes care to keep information accurate and current, it does not promise that every page is free of error or that every detail reflects the most recent change at the bench.

Hand made work has natural variation. Colour, surface texture and scent strength may differ slightly between one batch and the next, and such variation is not a defect. The studio describes its pieces honestly and does not claim that a poured piece will perform in a particular way in every room or in every condition.

To the extent permitted by law, the studio excludes any condition, warranty or term that would otherwise be implied into these terms. Nothing in these terms limits a right that the law gives you and that cannot be excluded.

18. Limitation of Liability

To the extent permitted by law, the studio is not liable for indirect or consequential loss, for loss of profit, for loss of a business opportunity or for any loss that was not reasonably foreseeable when the agreement was made.

Where the studio is liable for a loss connected with an order, its total liability is limited to the price paid for the piece or service that gave rise to the loss. This limit does not apply to liability for death or personal injury caused by negligence, to fraud or to any other liability that the law does not allow to be limited.

The studio is not liable for a loss caused by an event outside its reasonable control, such as a natural disaster, a power failure, a fire at the studio or a disruption to a postal or delivery service.

19. Indemnity

You agree to cover the studio for any reasonable loss, cost or claim that it faces because you have broken these terms, because you have supplied material that you did not have the right to use, or because you have used a poured piece in a way that caused harm to another person or to property.

The studio will tell you promptly if such a claim arises and will give you a reasonable chance to respond. The studio will not settle a claim in a way that admits fault on your part without your agreement, and you may take part in the defence with your own adviser at your own cost.

20. Governing Law and Disputes

These terms are governed by the law of the State of Utah, United States, without regard to conflict of law rules. The parties will first try to resolve a dispute by talking to each other in good faith, because most concerns at a small studio are settled quickly by a clear conversation.

If a dispute cannot be resolved by discussion, it may be brought before a court of competent jurisdiction in the county where the studio is located. Nothing in this section prevents a person from bringing a claim in a court that the law gives that person the right to use.

A delay in enforcing a right under these terms is not a waiver of that right. If one part of these terms is found to be unenforceable, the rest of the terms continue in force.

21. Changes to These Terms

The studio may update these terms from time to time to reflect a change in the services, in the studio or in the law. When a change is made, the effective date at the top of this page is updated and the new version is published here.

A change does not affect an order that has already been confirmed in writing unless the studio and the client agree otherwise. For a new order, the version of these terms in force on the day of confirmation applies.

We encourage you to review this page before you book a new service so that you are working from the current version.

22. Contact Information

If you have a question about these terms, an order or a service, please contact the studio. We will reply as clearly and as quickly as we can.
